INTRODUCTION

These Terms of Service ("Terms") govern your access to and use of TryPost.it ("TryPost", "we", "us", or "our"), an open-source social media scheduling platform operated by TryPost.

TryPost is available as both a cloud-hosted Software as a Service (SaaS) and as self-hosted open-source software. These Terms apply to users of our cloud-hosted service at trypost.it and related domains. Self-hosted users are subject to the applicable open-source license.

By accessing or using TryPost, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.


1. DEFINITIONS

1.1. "User" or "You": Any individual or entity that creates an account and uses TryPost's Services.

1.2. "Services": The TryPost social media scheduling platform, including all features, applications, and related services accessible through app.trypost.it.

1.3. "Platform": The TryPost software application and all associated tools, integrations, and functionalities.

1.4. "Content": Any text, images, videos, or other media that you upload, create, or schedule through TryPost.

1.5. "Social Media Channels": Third-party social media platforms that integrate with TryPost, including but not limited to:

  • Instagram (Meta)
  • Facebook (Meta)
  • LinkedIn
  • X (formerly Twitter)
  • TikTok
  • YouTube (Google)
  • Pinterest
  • Threads (Meta)
  • Bluesky
  • Mastodon

1.6. "Personal Data": Information relating to an identified or identifiable natural person.


2. OPEN SOURCE LICENSE

2.1. TryPost is open-source software released under the Functional Source License, Version 1.1, MIT Future License (FSL-1.1-MIT).

2.2. Under the FSL-1.1-MIT license:

2.2.1. You may use, copy, modify, and redistribute the software for any purpose other than competing with TryPost.

2.2.2. After the designated period specified in the license, the software becomes available under the MIT License.

2.2.3. The full license text is available at our GitHub repository.

2.3. The open-source nature of TryPost means:

2.3.1. You can self-host TryPost on your own infrastructure at no cost.

2.3.2. You can inspect, audit, and verify our source code.

2.3.3. You can contribute to the project's development.

2.3.4. There is no vendor lock-in; you maintain full control of your data.

2.4. These Terms of Service specifically govern the use of our cloud-hosted SaaS offering. Self-hosted deployments are subject to the FSL-1.1-MIT license terms.


3. DESCRIPTION OF SERVICES

3.1. TryPost is a social media scheduling and management platform that enables you to:

3.1.1. Schedule and Auto-Publish: Create and schedule posts to be automatically published across multiple social media platforms.

3.1.2. Visual Calendar: Plan and organize your content strategy using a drag-and-drop calendar interface.

3.1.3. Multi-Platform Management: Connect and manage accounts from Instagram, Facebook, LinkedIn, X, TikTok, YouTube, Pinterest, Threads, Bluesky, and Mastodon from a single dashboard.

3.1.4. Team Collaboration: Invite team members to collaborate on content creation and scheduling.

3.1.5. Media Library: Upload, organize, and manage your images, videos, and other media assets.

3.1.6. Post Preview: Preview how your posts will appear on each platform before publishing.

3.2. TryPost is provided as a SaaS (Software as a Service) accessible through web browsers without local installation requirements.

3.3. TryPost does not provide internet access. You are solely responsible for obtaining and maintaining the equipment and internet connection necessary to access the Services.


4. ACCOUNT REGISTRATION

4.1. To use TryPost, you must create an account by providing accurate and complete information.

4.2. You are responsible for:

4.2.1. Maintaining the confidentiality of your login credentials.

4.2.2. All activities that occur under your account.

4.2.3. Notifying us immediately of any unauthorized use of your account.

4.2.4. Keeping your account information up to date.

4.3. You must be at least 18 years old to create an account.

4.4. You may not create an account on behalf of someone else without their permission.

4.5. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.


5. ACCEPTABLE USE

5.1. You agree to use TryPost only for lawful purposes and in accordance with these Terms.

5.2. You agree NOT to:

5.2.1. Use the Services to violate any applicable law or regulation.

5.2.2. Post, schedule, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

5.2.3. Infringe upon the intellectual property rights of others.

5.2.4. Impersonate any person or entity.

5.2.5. Distribute spam, chain letters, or unsolicited communications.

5.2.6. Upload viruses, malware, or any malicious code.

5.2.7. Attempt to gain unauthorized access to our systems or other users' accounts.

5.2.8. Interfere with or disrupt the integrity or performance of the Services.

5.2.9. Use automated means (bots, scrapers, etc.) to access the Services without our express written permission.

5.2.10. Violate the terms of service of any connected Social Media Channel.

5.3. You are solely responsible for all Content you post through TryPost and for ensuring compliance with each Social Media Channel's terms and guidelines.


6. SOCIAL MEDIA CHANNEL INTEGRATIONS

6.1. TryPost integrates with various third-party Social Media Channels to enable scheduling and publishing functionality.

6.2. Supported Social Media Channels include:

6.3. Your use of these integrations is subject to:

6.3.1. The terms of service and privacy policies of each Social Media Channel.

6.3.2. The API limitations and guidelines of each platform.

6.3.3. Any changes to APIs or features that may affect functionality.

6.4. TryPost is not responsible for:

6.4.1. Changes to Social Media Channel APIs that may affect our Services.

6.4.2. Content moderation decisions made by Social Media Channels.

6.4.3. Account suspensions or restrictions imposed by Social Media Channels.

6.4.4. Data processing practices of Social Media Channels.

6.5. When you connect a Social Media Channel to TryPost, you authorize us to access and use your account data as necessary to provide the Services.


7. USER CONTENT

7.1. You retain all ownership rights to the Content you upload to TryPost.

7.2. By uploading Content, you grant TryPost a limited, non-exclusive license to:

7.2.1. Store, display, and process your Content to provide the Services.

7.2.2. Transmit your Content to Social Media Channels for publishing.

7.2.3. Create backups and copies for service reliability purposes.

7.3. You represent and warrant that:

7.3.1. You own or have the necessary rights to the Content you upload.

7.3.2. Your Content does not infringe on any third-party rights.

7.3.3. Your Content complies with all applicable laws and platform guidelines.

7.4. We may remove Content that violates these Terms or applicable laws without prior notice.


8. PRICING AND PAYMENT

8.1. TryPost offers paid subscription plans. There is no free plan available.

8.2. Current pricing is available at trypost.it/pricing.

8.3. For subscriptions:

8.3.1. Payment is due in advance on a monthly or annual basis.

8.3.2. Subscriptions automatically renew unless cancelled before the renewal date.

8.3.3. We accept payment via credit card and other methods as specified.

8.4. You may cancel your subscription at any time through your account settings.

8.5. Refunds are provided in accordance with our refund policy. Generally, we do not provide refunds for partial subscription periods.

8.6. We reserve the right to modify pricing with 30 days' notice to existing subscribers.


9. FREE TRIAL

9.1. TryPost offers a 7-day free trial for new users.

9.2. The trial provides full access to all paid features for 7 days.

9.3. After the trial period ends, you must subscribe to a paid plan to continue using the Services.

9.4. We reserve the right to modify or discontinue the trial offer at any time.


10. INTELLECTUAL PROPERTY

10.1. TryPost and its original content, features, and functionality are owned by TryPost and are protected by international copyright, trademark, and other intellectual property laws.

10.2. Subject to the FSL-1.1-MIT open-source license for the software code:

10.2.1. The TryPost name, logo, and branding are trademarks of TryPost.

10.2.2. You may not use our trademarks without written permission.

10.3. You retain ownership of all Content you create and upload to TryPost.


11. PRIVACY AND DATA PROTECTION

11.1. Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy at trypost.it/privacy.

11.2. We are committed to protecting your data and complying with applicable data protection laws, including:

11.2.1. General Data Protection Regulation (GDPR) for EU users.

11.2.2. California Consumer Privacy Act (CCPA) for California residents.

11.2.3. Other applicable regional data protection laws.

11.3. By using TryPost, you consent to the collection and use of your information as described in our Privacy Policy.


12. DISCLAIMER OF WARRANTIES

12.1. TryPost is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

12.2. We do not warrant that:

12.2.1. The Services will meet your specific requirements.

12.2.2. The Services will be uninterrupted, timely, secure, or error-free.

12.2.3. The results obtained from using the Services will be accurate or reliable.

12.2.4. Any errors in the Services will be corrected.

12.3. You acknowledge that Social Media Channel integrations are dependent on third-party APIs and may be subject to interruptions or changes beyond our control.


13. LIMITATION OF LIABILITY

13.1. To the maximum extent permitted by applicable law, TryPost and its affiliates, officers, directors, employees, and agents shall not be liable for:

13.1.1. Any indirect, incidental, special, consequential, or punitive damages.

13.1.2. Any loss of profits, revenue, data, or business opportunities.

13.1.3. Any damages resulting from your use or inability to use the Services.

13.1.4. Any damages resulting from unauthorized access to or alteration of your data.

13.1.5. Any third-party conduct or content on the Services.

13.2. Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to TryPost in the 12 months preceding the claim.

13.3. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.


14. INDEMNIFICATION

14.1. You agree to indemnify, defend, and hold harmless TryPost and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

14.1.1. Your use of the Services.

14.1.2. Your violation of these Terms.

14.1.3. Your Content.

14.1.4. Your violation of any rights of another party.


15. TERMINATION

15.1. You may terminate your account at any time by contacting us or using the account deletion feature.

15.2. We may suspend or terminate your account immediately, without prior notice, if:

15.2.1. You violate these Terms.

15.2.2. Your use poses a security risk to the Services or other users.

15.2.3. We are required to do so by law.

15.3. Upon termination:

15.3.1. Your right to access the Services will cease immediately.

15.3.2. You may request an export of your data within 30 days.

15.3.3. We may delete your data after 30 days following termination.

15.4. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.


16. CHANGES TO TERMS

16.1. We reserve the right to modify these Terms at any time.

16.2. We will notify you of significant changes by:

16.2.1. Posting the updated Terms on our website.

16.2.2. Sending an email to your registered email address.

16.2.3. Displaying a notice within the application.

16.3. Changes will be effective 30 days after posting for existing users, and immediately for new users.

16.4. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.


17. GOVERNING LAW AND DISPUTE RESOLUTION

17.1. These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

17.2. TryPost is operated by a company based in São Paulo, Brazil.

17.3. Any disputes arising from these Terms or your use of the Services shall be resolved through:

17.3.1. Good faith negotiation between the parties.

17.3.2. If negotiation fails, the courts of São Paulo, Brazil shall have exclusive jurisdiction.

17.4. For users outside Brazil, you agree that any disputes will be resolved under Brazilian law in the courts of São Paulo.


18. MISCELLANEOUS

18.1. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TryPost regarding the Services.

18.2. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

18.3. Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

18.4. Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.5. Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
